Terms & Conditions

The following terms and conditions (“Terms & Conditions”) shall apply to The Ultimate Lifestyle Giveaway (“Giveaway”). Please read the terms carefully if you are interested in participating.

By entering the Giveaway, I (“Entrant”) I confirm I am at least 18 years old. And accept the Terms and Conditions set forth. I also agree to sign up to receive newsletters and be contacted for special offers and/or promotions from Vaniday (‘The Organizer’) and its partners such as Retreat yourself Box, Urban you, Zanui, Carousell, Reebonz, Gritty Pretty collectively known as (“The Sponsors”)

1. Eligibility: The Ultimate Lifestyle Giveaway  (“Giveaway”) is only open to all participants above the age of 18 years and to Australian Residents.
2. The following are ineligible: (i) employees of “The Organizer”, the “Sponsors” or any of the tenants or retailers or any other agencies that are associated with the Giveaway; (ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) any person who the Organizer has previously notified is not permitted to enter the Organizer’s promotions.
3. Vaniday (“The Organizer”) has the sole discretion to exclude any person from participating in the Giveaway without any obligation to furnish any notice and/or reason..
4. Agreement to Official Rules: Submitting an entry automatically means you are agreeing to abide by these Terms and Conditions. By entering the Giveaway, you indicate your full and unconditional agreement to, and acceptance of, (a) these Terms & Conditions and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein
5. This Giveaway commences at 12.01am (AEDT) on Wednesday 11th October 2017 and ends at 11.59pm (AEST) on Tuesday 31th October  2017 (“Giveaway Period”)
6. Entry Period: Entries must be submitted by 31th October 2017, 11:59pm AEDT (the “Deadline”). The Organiser reserves the right to amend the Deadline at any time without prior notice. All entries received thereafter will automatically be disqualified.
7. How to Enter: At the beginning of the Entry Period, you may enter the giveaway by visiting the giveaway site http://australia-giveaway.webflow.io/ It is necessary to fully complete the official online entry form, including their full name, valid email address and their post code of residence or work and submit the entry form online. The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion.
8. In case of any entrant's misconduct, fraud or abuse, The Organizer reserves the right to disqualify the entrant. Entries generated via script, macro or other automated means will also be disqualified. The Company also reserves the right to disqualify any entrant/entry without having to enter into any correspondence regarding the decision. Bulk, suspicious and/or third party entries will be void.
9. Drawing: The Organizer will select one potential winner in a random drawing of all entries received. The odds of being selected depend on the number of entries received.
10. Notification and Requirements of Potential Winners: A winner will be notified via email and/or telephone latest by 31 November 2017.
11. Prize(s): One (1) winner will only be chosen to win the prize as stated on site http://http://australia-giveaway.webflow.io/ that will only be announced at The Organizer’s sole and absolute discretion.
12. If a winner cannot be contacted or does not respond within two weeks upon receiving the announcement notification the prize or prize notification will be invalid and the winner forfeits all rights to any prize. All decisions of The Organizer are final and binding in all respects.
13. The Prize is not transferable, exchangeable for cash or any other items. The Organizer reserves the right to substitute the prizes for other prizes of similar value at its sole and absolute discretion without notice to the Participants and/or Winners.
14. Winners are responsible for paying any applicable income taxes any and all other costs and expenses not listed in the giveaway. Any prize details not specified will be determined by The Sponsors in its sole discretion. A prize may not be transferred and must be accepted as awarded. You may not request cash or a substitute prize; however, The Sponsors reserves the right to substitute a prize with another prize if the prize is not available for any reason, as determined by Sponsor in its sole discretion.
15. Use of Entrant Information: By entering the Giveaway, you acknowledge and agree that the participating companies Vaniday, Retreat yourself box, Urban you, Zanui, Carousell, Reebonz,  Gritty Pretty are allowed to use the Entrant’s information, including, without limitation, your e-mail address, for general solicitation, marketing, or other business or promotional activities in connection with the services and products provided by Sponsors. You may at any time revoke the use of such information by providing written notice to each other participating company.
16. The Organizer reserves the right to disclose and publish the name and any other particulars of the winner(s) (including photographs) for publicity purposes of this Giveaway. The winner agrees to co-operate with and participate in the associated activities organized by the Organizer.
17. Third Party Platforms: If this Giveaway is hosted, administered,operated on a third party platform, including without limitation a social media platform (e.g. Facebook or Twitter) (“Third Party Platform”), then by participating in this Giveaway, entrants hereby release and agree to comply with all rules and policies set forth by such Third Party Platform and to hold harmless such Third Party Platform from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize related activities. Unless otherwise stated to the contrary in these Terms & Conditions, this Giveaway is not sponsored, endorsed or administered by, or associated with, any Third Party Platform.
18. The Organizer reserves the right to withdraw or cancel the Giveaway to amend or change these Terms and Conditions at any time for whatever reason and without giving prior notice to the Participants. The decision of The Organizer on all matters relating to or in connection with the Giveaway is final, and no correspondence will be entertained.
19. The Organizer reserves the right to disqualify anyone who has tampered with or disrupted the entry process or operation of this Giveaway or violated the rules. If the Giveaway cannot be run as planned for any reason, including technical problems, The Organizer reserves the right to cancel, curtail, modify or suspend the Giveaway. In the event the Giveaway is terminated early, a winner will be selected from all eligible entries received at the time of termination.
20. The Sponsors & The Organizer, its related corporations and/or emees shall not be liable for: (1) any incorrect or inaccurate information, whether caused by entrant, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the entrant's participation in Giveaway or receipt or use or misuse of any prize; (7) misdirected or undeliverable entries or any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof; (8) any typographical/other error in entries, selection announcement or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with this Giveaway.
21. The Organizer and The Sponsors shall not be liable to any person the Giveaway for any injuries, losses or damages in respect of, in connection with and/or arising from the Giveaway.
22. A Participant shall fully indemnify and hold The Organizer and Sponsors harmless from and against any loss, damage, cost, liability or expense (including legal fees), whether direct or indirect, which The Organizer incurs in respect of, in connection with and/or arising from the Participant’s breach of these Terms and Conditions.
23. In the event of any inconsistencies or discrepancies between Terms and Conditions and the contents of any brochure, marketing and/or promotional materials relating to the Giveaway, Terms and Conditions shall prevail.
24. A person who is not a party to any agreement governed by these Terms and Conditions shall have no rights under the contracts to enforce any of these Term and Conditions.
25. The Terms and Conditions shall be governed by and interpreted in accordance with the Australian law. The Courts of Australia shall have exclusive jurisdiction over any disputes arising from these Terms and Conditions, including the validity and enforceability thereof.
26. The “Organizer” is Vaniday Pty Ltd (ABN 31606112305) of 3 Blackfriars Street, NSW 2008.
